USCIS Memo on Third-Party Placements


USCIS issued a memo in February 2018 to support its requests for the contracts and work orders between all parties involved in a placement. While this appears to be overreach that will be struck down sooner than later, that doesn’t help you today. So what can you do?

Here are 5 actions to take:

  1. Closely review every single document available.

  2. Ask if the on-site managers can help.

  3. Find ways to benefit from confidentiality clauses.

  4. Get creative with online searches.

  5. File requests for documents that may be public.

This can be a tough issue, but keep looking into all of the possibilities and don’t be afraid to try novel arguments until you get the results you need.
